Financial and banking data: Account numbers, banking entity, proof of origin of funds, source of income, economic profile, transfer and deposit history.

Technical and navigation data: IP address, unique device identifiers, browser type and version, operating system, time zone, approximate geographical location, platform access logs, cookies, and similar technologies.

Operational activity data: Trading order history, financial results, behavior within the platform (MetaTrader, CRM, user panel, etc.), frequency and type of operations.

Documentation and images: “Selfie” photos or videos, copies of passports, driver’s licenses, bank statements, sworn declarations, KYC/AML verification forms and questionnaires.

Important: In certain cases, we may also collect publicly accessible information or information from fraud prevention databases, international sanctions lists, or external verification providers, as permitted by applicable law.

4. Purposes of Processing

Personal data collected by SCAP Broker LTD will be processed lawfully, transparently, and securely for the following specific purposes:

Execution of the contractual relationship: To allow Client registration, identification on our platforms, and full access to the services offered by SCAP Broker LTD, including trading platforms, PAMM accounts, and user panels.

Regulatory compliance: To carry out identity verification processes, due diligence, and continuous monitoring in accordance with Know Your Customer (KYC), Anti-Money Laundering (AML), and Counter-Terrorist Financing (CFT) standards, as well as what is required by regulatory bodies in our operating jurisdictions.

Operational and financial management: To process financial transactions, deposits, withdrawals, fund allocations, commission management, and any other operation authorized by The Client.

Legal compliance and institutional cooperation: To address formal requirements from regulatory, tax, judicial, or security authorities, both locally and internationally.

Risk prevention and security: To monitor, detect, prevent, and mitigate possible fraud, unauthorized access, system abuse, and security vulnerabilities within our platforms.

Analysis, statistics, and service improvement: To conduct internal studies, user segmentation, behavior analysis, satisfaction surveys, and continuous improvements in The Client’s experience.

Institutional communications: To send notifications related to contractual updates, terms of use, technical maintenance, regulatory changes, new products, or functionalities relevant to The Client.

Note: SCAP Broker LTD does not use personal data for purposes incompatible with those indicated here or for mass marketing activities without the prior consent of the data subject.

5. Legal Basis for Processing

The processing of personal data by SCAP Broker LTD is based on one or more of the following legal bases, depending on the applicable jurisdiction and the nature of the relationship with The Client:

Execution of a contract: Processing is necessary for the execution of the service contract entered into between The Client and SCAP Broker LTD, including access, use, and operation of investment accounts, trading platforms, and other financial services provided.

Compliance with legal and regulatory obligations: SCAP Broker LTD must process certain personal data to comply with local and international legal provisions, including those related to anti-money laundering (AML), terrorist financing (CFT), tax requirements, and regulatory reports.

Informed consent of the data subject: In certain cases, data processing is carried out based on the free, prior, express, and informed consent of the data subject, such as in subscribing to commercial communications, submitting forms, or biometric validations.

Legitimate interest of the controller: SCAP Broker LTD may process data when necessary for the efficient management of its activity, continuous service improvement, traceability of operations, security of the technological infrastructure, or detection of irregular conduct, always ensuring that the fundamental rights of the data subject are not violated.

6. Recipients of the Data

SCAP Broker LTD may share The Client’s personal data only with duly authorized third parties and in the following cases:

Regulatory and governmental authorities: When required by law, applicable regulations, or judicial order, data may be shared with entities such as the Financial Sector Conduct Authority (FSCA), Financial Transactions and Reports Analysis Centre of Canada (FINTRAC), Financial Crimes Enforcement Network (FinCEN), tax authorities, courts of justice, or enforcement agencies.

Technological and operational service providers: Third-party contractors providing essential services to SCAP Broker LTD —such as identity verification, anti-fraud analysis, cloud services, payment processing, technological platforms, IT maintenance, or legal services— may access data only to the extent necessary to fulfill their functions, under strict contractual clauses of confidentiality and data protection.

Auditors, consultants, and external advisors: For auditing, regulatory compliance, or operational improvement purposes, data may be reviewed by contracted experts, always within a legal and secure framework.

Affiliated companies of the same business group: Information may be shared with entities controlled by, controlling, or affiliated with SCAP Broker LTD, solely for administrative, operational, or compliance purposes, and never for commercial purposes without The Client’s prior consent.

SCAP Broker LTD does not sell, rent, or commercialize the personal data of its Clients, under any circumstance.

7. International Transfers

Due to the international nature of SCAP Broker LTD’s operations and the use of cloud services, the personal data of Users, Clients, or Visitors may be transferred, processed, and stored on servers located outside the data subject’s country of residence, including countries where our technological providers, group entities, or strategic partners operate.

SCAP Broker LTD guarantees that all international transfers of personal data are carried out under one or more of the following protection mechanisms:

Standard Contractual Clauses approved by the European Commission or equivalents in other applicable jurisdictions;

In all cases, SCAP Broker LTD undertakes to implement appropriate technical and organizational measures to protect the confidentiality, integrity, and availability of transferred data.

8. Data Retention

SCAP Broker LTD will retain personal data only for the time necessary to fulfill the purposes described in this Privacy Policy, or for a longer period if required by:

Applicable legal or regulatory provisions (e.g., financial, tax, or anti-money laundering requirements);

The contractual relationship with The Client or User;

Legitimate needs for legal defense or dispute resolution.

In any case, data will be retained for a minimum period of five (5) years counted from the last active interaction of the data subject with the Company, unless otherwise provided by regulatory provisions.

Once the retention period has expired, data will be securely deleted or anonymized, in accordance with established technical protocols and current legislation.

9. Rights of the Data Subject

Every Client, User, or Visitor whose personal data is processed by SCAP Broker LTD will have the right to exercise, at any time and free of charge, the following rights:

Access: Obtain confirmation as to whether their data is being processed and access such information.

Rectification: Request the correction of inaccurate, incomplete, or outdated data.

Erasure: Request the deletion of their data when it is no longer necessary for the stated purposes, or when the legal retention period has expired, unless there is a regulatory obligation to the contrary.

Objection: Object to the processing of their data for legitimate reasons related to their particular situation.

Portability: Receive their data in a structured, commonly used, and machine-readable format, or request its direct transfer to another controller (when technically possible).

Withdrawal of consent: Withdraw at any time the consent given for specific purposes, without affecting the lawfulness of prior processing.
